Did anyone else catch the interview with Eugene Volokh on TV?

I caught only the last 30 seconds or so. He was interviewed
on Fox News (one of correspondent-in-New-York, expert-in-Los-Angeles
deals) on Friday, July 4th, at around 3:20pm Pacific Time (10:20pm GMT).

It was something to do with whether or not the U.S. Government has
the right to set laws concerning an employee's behaviour in the
work place. (No doubt that's not exactly it, but I think it's close.)

Can anyone provide more details?
