That would be the constitutional responsibility of Congress.  At least
that's
what it says in the Constitution of the USA.  Clearly this must not be a war
as Congress has been quite silent on the subject and hasn't even entertained
a bill to declare war let alone passed such a bill.  Would this possibly be
considered ducking responsibility?

Congress has given it's permission for the President to take care of this
Iraq situation.  It is not a declaration of war, but it is enough.
