UT and/or UTC rules and by-laws may not supersede Federal or State
laws concerning the right to organize which is guaranteed by both the
State and the US Constitution.

"...the citizens have a right, in a peaceable manner, to assemble
together for their common good, to instruct their representatives,
and to apply to those invested with the powers of government for
redress of grievances..."(Tennessee Constitution, Art. I, Sec. 23)

"Congress shall make no law...abridging the freedom of speech, or of
the press; or the right of the people to peaceably assemble, and to
petition the government for redress of grievances."(U.S.
Constitution, Amendment I)

STATE ATTORNEY GENERAL OPINION SUPPORTS THE RIGHT TO JOIN A UNION

"Public employees may organize or join a labor organization for the
purpose of selecting representatives to meet and confer with public
employers on matters affecting employees."(TN State Attorney General
Opinion 98-168; 8-27-98)
