The following memo was recently sent to administrators on all UT campuses by
Sylvia Davis, UT System Vice President for Business and Finance. Copies of
the text of the Governor's Executive Order 28 may be obtained from Personnel
Services (contact Melanie Sadler at 755-4729). Please direct questions

SUBJECT:        Executive Order 28 Relative to Military Leave


On September 27, 2001, Governor Sundquist signed Executive Order 28 that
provides a salary supplement to individuals called to active military duty
by the President of the United States. The following is a summary of the
provisions of the Executive Order and the procedures the University will
follow to comply with the intent of that order.

1. The order applies to those employees called to active full-time military
duty by the President in support of an operation undertaken in response to
the terrorist attacks that occurred on September 11, 2001.

2. While on active duty, University employees affected by the Executive
Order will receive a salary supplement up to the difference between the
employee's University monthly base salary and the monthly military base
salary not to exceed $1,000 per month. While on this military leave of
absence with pay, affected employees will continue to accrue annual and sick
leave, be eligible to receive longevity pay, and accrue creditable service
for retirement based on their base salary at the time of entering into
active duty. Employees will have the option of continuing in the following
covered benefits: basic health and life insurance, optional life insurance,
dental insurance, 401k deferred compensation (maximum allowable deferral of
$20 to be eligible to receive the $20 match) and medical benefits covered by
the flexible benefits plan.

3.      The leave of absence with pay, which includes the salary supplement
and/or payment for related benefits, shall be in effect for a maximum period
of six (6) months. After this period, the salary supplement will end and
eligibility for continuation of benefits will be in accordance with standard
University policies and guidelines. If employees have not used all of their
15 days of annual military leave, they are entitled to up to 15 days of this
military leave with full pay and benefits.

4. Human Resources officers will work with departments to obtain a copy of
military orders for individuals called to and released from active duty to
determine the effective dates of the leave. That information should then be
relayed to the University-wide Payroll Office.

5. The University-wide Payroll Office will be responsible for obtaining the
monthly military base salary from the Tennessee Department of the Military
and determining the amount of the monthly salary supplement. The information
will be relayed back to the responsible Human Resources Office and that
office will contact the individual's responsible department to assist with
the completion of the Personal Action Form (PAF). A copy of the employee's
official military orders must be attached to the PAF. The employee's base
salary in effect at the beginning of the leave will be used to determine
benefits. The salary supplement should be charged to the distribution
accounts in effect at the time of entry into active duty or the account(s)
determined by the campus/unit business officer.

6.      Any employee receiving a salary supplement from The University of
Tennessee as a result of this order will be placed on military leave of
absence with pay. In the event the employee does not return to work after
the six (6) month period, another Personnel Action Form must be completed to
place the employee on military leave without pay.
