That's how it should be. Why not the OPEN-Mpe members vote on the NDA?

Hello one and all:

Maybe, another solution to the NDA is to make the NDA document available
to all OPENMPE for viewing and comments.

Then the OPENMPE group can either allow the Board to accept it as is or
request changes to be made.

Personally, I believe the source code should be under NDA but
discussions should be out in the open.

Just my opinion.
