Answer to last part:
This is not quite a quote, but at one time or another in
one venue or another in the not too distant past, HP (at
least so far) has essentially said:
"We choose to exercise our intellectual property rights to
MPE in this way";
i.e.: So far they are not willing to allow what is technically
possible.
