I believe you are referring to the case where the Supreme Court declared
the Texas sodomy law to be unconstitutional.  In fact, the Supreme Court
should have passed on that case.  These laws were being taken off the
books in various places and would have disappeared on their own.  The SC
went out of its way to take this one and by doing so, opened a huge can
of worms.  The remedy to a small, disappearing problem, created a huge
problem.
