Make it dependent upon the capabilities of the session running the
transfer.  Them that can change the file code to non-priv might as well be
able to take the file in its original state rather than forcing them to go
through the hoops of changing the file code back and forth. On the other
hand, a confirmation window would be a nice feature here:

Warning Will Robinson! Warning!
This file has a PRIVILEDGED file code!
Do you wish to proceed with transfer?
NO/yes
