I use it on a desktop at home...runs fine. And "people don't use it on desktop... because it's developed for free..." is illogical. Then the next sentence contradicts all this! It's those "programmers all over the world" working "pro bono publico" that have brought Linux to where it is today. The judge should make up his mind one way or the other.
And, in the true spirit of laissez-faire capitalism, where there's a market, people will come along to satisfy that market's desires; look at companies like Red Hat, Linuxcare, etc. to get an idea of where Linux stands and where it's heading (heck, check out HP's IT Resource Center; HP likes Linux too..:-). The old "no support" argument doesn't hold water anymore...just more M$FUD...
