Yes, Hitler declared war on the US, but never attacked.
On the other hand, Saddam Hussein was under s cease-fire agreement and
kept firing SAMs at US and British planes patrolling the no-fly zones,
(Operations Northern and Southern Watch(es),) in complete defiance of
the cease-fire agreement.
Also, when you fire Surface to Air Missiles (SAM) at another country's
plane, that IS an overt act of war and aggression.

Depends upon what you define attack to mean. Germany declared war
upon the United States of America on the morning of December 11, 1941
to take effect immediately upon presentation of the German diplomatic
note to the American government in Washington, D.C. That afternoon,
Roosevelt requested and received a Congressional declaration of war
on Germany in response to a fait accompli.
