A quick check of my "pocket Constitution" provided by the Cato
Institute and a check of
http://www.archives.gov/national_archives_experience/charters/bill_of_ri
ghts_transcript.html reveals no mention of sex, age, race or handicap.
A short history lesson for those that may be mixing later laws and
court rulings with baseline historical documents that are the
foundation of our Republic (yes, the United States is a representative
republic, not a democracy, as the phrase in the pledge shows: "and to
the Republic for which it stands") the first ten amendments to the
Constitution are collectively called the "Bill of Rights" - the
subsequent 16 amendments are simply referred to as amendments.

Also only amendments five and six mention crime(s) and these two
amendments spell out the rights of the accused, not of the
classification of offenses being designated as crimes.
