Having read the H1-B visa requirements Paul Taffel referred us to, I find
that, in the cases I am immediately aware of, at least the public notice
posting requirement was not met.

As far as whether hiring the H1-B candidate will not "hurt" working
conditions of US workers, 1) the burden of proof on the employer is vague
and non-specific, and 2) is subject to verification by the government only
if that case is selected for audit.

H-1B visa applicants are required to submit proof that the salary being
paid
is at least that of workers who perform the same job function in the same
geographic area.  H1-B is not (in my experience) a way of finding cheap
labor, it's a way of bringing in talent that's unavailable locally.
